Official Terms and Conditions — Treat Accessibly Halloween Villages, REMAX Agent Program 2026

These Official Terms and Conditions (“Terms”) govern participation in the Treat Accessibly Halloween Villages — REMAX® Agent Program 2026 (the “Program”), licensed by PADULO X INC., operating as Treat Accessibly (“Treat Accessibly”, “we”, “our” or “us”). By submitting a Nomination, accepting Selection, accepting Program Funds or otherwise participating in the Program, each Agent Participant agrees to be legally bound by these Terms. If you do not agree to these Terms, you may not participate.

  1. Program Purpose

The Program is a national community initiative established by Treat Accessibly, fully funded through the partnership with REMAX, to support REMAX Agents and Offices that demonstrate leadership in making Halloween more accessible, welcoming and inclusive for children of all abilities. Ten (10) REMAX Agents or Offices across Canada will each be allocated five thousand Canadian dollars ($5,000 CAD) in Program Funds to independently produce a Treat Accessibly Halloween Village event on a real street or community gathering place in October 2026.

The Program is a discretionary community initiative and is NOT a contest, sweepstakes, lottery, game of chance or prize promotion. No purchase is necessary. Submitting a Nomination does not create any right, entitlement or expectation of Selection, Program Funds or support of any kind. Treat Accessibly reserves the right to establish, modify or discontinue the Program, its requirements, participation criteria and available support at any time in accordance with these Terms.

  1. Headings

The section headings in these Terms are included for convenience only and shall not affect the interpretation of these Terms.

  1. Definitions

“Agent Participant” means the REMAX Agent or REMAX Office selected to participate in the Program, including the individual who submitted the Nomination and any team members acting on their behalf.

“Nomination” means the submission of the online self-nomination form requesting consideration for participation in the Program. A Nomination does not create any right, entitlement or expectation of Selection.

“Program” means the Treat Accessibly Halloween Villages — REMAX Agent Program 2026, including all related activities, communications, materials and support.

“Program Funds” means the $5,000 CAD allocation paid by Treat Accessibly to each selected Agent Participant to support the production of their Village Event. Program fund provided to Treat Accessibly by REMAX Canada.

“Program Materials” means all marks, logos, lockups, templates, playbooks, guides and other materials provided by Treat Accessibly for use in connection with the Program.

“Released Parties” means Treat Accessibly, PADULO X INC., the Founding Family, REMAX, REMAX Canada, other Treat Accessibly and REMAX Corporate program sponsors, partners, affiliates, successors, assigns, officers, directors, employees, contractors, volunteers, representatives, agents, media and social content producers, and their respective insurers.

“Selection” means the decision by Treat Accessibly and supported by REMAX corporate, made in their sole and absolute discretion, to invite a nominated Agent to participate in the Program. Selection is not a prize, award or entitlement and may be revoked in accordance with these Terms.

“Village Event” means the accessible Halloween community event independently produced by an Agent Participant under the Program, on either (a) a late-October date, or (b) October 31, 2026.

  1. Eligibility

To be eligible, an Agent Participant must: (a) be a licensed real estate professional affiliated with REMAX, or a REMAX Office, in good standing; (b) be the age of majority in the province or territory in which they reside; (c) operate in Canada, excluding the Province of Quebec, unless otherwise determined by Treat Accessibly and REMAX Corporate; (d) submit a complete and accurate Nomination by September 1, 2026 in the manner prescribed by Treat Accessibly; (e) agree to comply with these Terms and all applicable federal, provincial and municipal laws, regulations and bylaws, including real estate advertising and licensing rules applicable to the Agent; and (f) provide any information or documentation reasonably requested to verify eligibility or administer the Program.

Treat Accessibly reserves the right, in its sole and absolute discretion, to determine eligibility at any time before or during the Program and may disqualify any Agent Participant that does not satisfy these requirements or otherwise fails to comply with these Terms.

  1. Selection

5.1 Process. Participation is by invitation following review of Nominations. Selection is not determined by chance, random draw, scoring system, contest, sweepstakes or lottery. Treat Accessibly and REMAX corporate will review all eligible Nominations and select approximately ten (10) Agent Participants on or about September 15, 2026.

5.2 Criteria. Without limiting discretion, Selection may consider: the Agent’s demonstrated community commitment; the suitability and accessibility readiness of the proposed street or gathering place; anticipated community participation and trick-or-treater turnout; the Agent’s event and community-organizing experience; geographic diversity; and any other factors considered relevant. These criteria are general guidelines only.

5.3 Sole Discretion. All Selection decisions are made in the sole and absolute discretion of Treat Accessibly and REMAX corporate, who may accept or decline any Nomination, request additional information, select fewer or more Agent Participants than anticipated, revoke or withdraw a Selection, and make any other decision reasonably necessary to administer the Program, without obligation to provide reasons.

5.4 No Entitlement. Submitting a Nomination creates no right, entitlement or expectation of Selection or Program Funds. Selection constitutes an invitation to participate and remains conditional on confirmation of eligibility, acceptance of these Terms and continued compliance with all Program requirements.

  1. Agent Participant Obligations — Independent (DIY) Execution

Participation is voluntary; however, upon accepting Selection, each Agent Participant agrees to: (a) independently plan, organize, produce and execute their Village Event as their own event, including all logistics, staffing, volunteers, sourcing and spending decisions; (b) obtain, at their own cost and responsibility, all municipal permissions, permits, licences and insurance required for their Village Event; (c) use Program Funds for the purposes of producing the Village Event, maintain reasonable records of expenditures, and provide documentation if reasonably requested; (d) attend the two scheduled Program Zoom sessions (kick-off, on or about October 1, 2026; check-in, on or about October 15, 2026); (e) follow the accessibility standards described in the Program playbook, including front-of-lawn/driveway treat stations with no stairs or barriers; (f) use Program Materials only as provided and in accordance with brand guidelines; (g) identify themselves and their office using their own branding, produced at their own cost; (h) promptly notify Treat Accessibly of any material change affecting their ability to execute; and (i) conduct the Village Event in a safe, respectful and inclusive manner.

Treat Accessibly’s role is limited to providing rights to use its marks, the playbook, two Zoom sessions, community templates and the Program Funds. Treat Accessibly does not organize, supervise, direct or control the Village Event.

  1. Failure to Comply; Revocation and Return of Funds

If an Agent Participant fails to comply with these Terms, fails to execute a Village Event, uses Program Funds for purposes unrelated to the Village Event, or engages in conduct that could damage the reputation of Treat Accessibly, REMAX or any partner, Treat Accessibly may, in its sole discretion: issue a warning; suspend or revoke participation; require the return of all or part of the Program Funds; and/or withdraw the licence to use Program Materials, in each case without liability to Treat Accessibly.

  1. Program Funds

Program Funds of $5,000 CAD per selected Agent Participant are paid by Treat Accessibly on or about November 2nd, 2026, following acceptance of these Terms. Program Funds are a fixed allocation: no additional reimbursement, top-up or expense claim is available, and any spending beyond Program Funds is entirely the Agent Participant’s own decision and responsibility. Agent Participants are solely responsible for any tax consequences of receiving Program Funds and should consult their own advisors. Any portion of Program Funds not used for the Village Event shall, at Treat Accessibly’s option, be returned or donated as directed by Treat Accessibly.

  1. Intellectual Property

All Program Materials, including the Treat Accessibly name, marks, logos and lockups, remain the exclusive property of Treat Accessibly (or their respective owners). Selected Agent Participants receive a limited, revocable, non-exclusive, non-transferable licence to use Program Materials solely in connection with their 2026 Village Event and in accordance with brand guidelines. Agent Participants shall not alter, distort or recolour the marks, create derivative Treat Accessibly-branded products or signage beyond the provided templates, imply endorsement of their real estate services or listings, or use the marks after the Program ends. REMAX marks remain the property of REMAX and are used by Agents under their existing agreements with REMAX.

  1. Media Release and Publicity

Agent Participants agree that Treat Accessibly and REMAX may photograph, record, publish and promote the Program and Village Events, and may identify Agent Participants and their Village Events publicly. Agent Participants grant the Released Parties a perpetual, royalty-free license to use images, recordings, names, likenesses and statements arising from the Program for promotional and archival purposes, without further compensation. Agent Participants are responsible for obtaining appropriate permissions for photography they capture at their own Village Event, particularly involving children.

  1. Privacy

Personal information collected through the Nomination form and Program administration is collected, used and disclosed to administer the Program, communicate with participants and fulfil legal obligations, in accordance with Treat Accessibly’s privacy practices and applicable privacy laws. Nomination data may be shared with REMAX corporate for the purpose of Selection and Program administration.

  1. Program Communications

Program communications will be sent to the email address provided in the Nomination. Agent Participants consent to receiving Program-related communications from Treat Accessibly and REMAX corporate.

  1. Sponsors and Partners

Program sponsors and partners provide financial, promotional, product or other support but do not administer or operate the Program and have no responsibility for Village Events.

  1. Assumption of Risk, Release, Disclaimer and Indemnity

14.1 Voluntary Participation and Assumption of Risk. Participation is entirely voluntary. Each Agent Participant acknowledges that their Village Event and all associated activities occur entirely at their own risk, and that they are solely responsible for determining that the location, stations, decorations, equipment, walkways, lighting and activities are safe and suitable for all attendees. Risks include, without limitation: personal injury or death; slips, trips and falls; allergic reactions; illness; property damage; theft or vandalism; vehicle or pedestrian incidents; weather-related hazards; interactions with members of the public; criminal acts of third parties; accessibility-related incidents; crowd management issues; and any other known or unknown risks. Each Agent Participant voluntarily assumes all such risks.

14.2 Independent Execution. Treat Accessibly does not own, occupy, control, supervise, inspect, maintain or manage any Village Event location, and does not organize, supervise, direct or control the activities of Agent Participants, volunteers, visitors or members of the public. Each Agent Participant remains solely responsible for their own conduct, event, property, activities and decisions, including compliance with real estate regulatory requirements applicable to their marketing.

14.3 Release. To the fullest extent permitted by law, each Agent Participant, on behalf of themselves and their heirs, executors, administrators, successors and assigns, irrevocably releases and forever discharges the Released Parties from any and all claims, demands, causes of action, damages, liabilities, losses, costs and expenses of every kind arising out of or relating to participation in the Program or the production of a Village Event, except where such liability cannot legally be excluded.

14.4 Indemnity. Each Agent Participant shall indemnify, defend and hold harmless the Released Parties from and against any and all claims, damages, liabilities, losses, costs and expenses (including reasonable legal fees) arising out of or relating to: the Agent Participant’s Village Event; any act or omission of the Agent Participant, their team, volunteers or contractors; any breach of these Terms; any failure to obtain required permits or insurance; and any injury, loss or damage suffered by any person attending or affected by the Village Event.

  1. Limitation of Liability

To the fullest extent permitted by law, the Released Parties shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits or reputational harm, arising from the Program. In no event shall the aggregate liability of the Released Parties to any Agent Participant exceed the amount of Program Funds actually paid to that Agent Participant.

  1. No Waiver of Statutory Rights

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified under applicable consumer protection or other legislation.

  1. Force Majeure

Treat Accessibly is not responsible for any failure or delay in administering the Program caused by events beyond its reasonable control, including weather, public health measures, government action, labour disruption or infrastructure failure. Agent Participants acknowledge that outdoor Halloween events are weather-dependent and that no compensation is payable if a Village Event is modified, postponed or cancelled.

  1. General Provisions

These Terms constitute the entire agreement between the parties relating to the Program and supersede all prior discussions. If any provision is held invalid, the remaining provisions continue in full force. No failure to enforce any provision constitutes a waiver. Agent Participants may not assign their participation. Nothing in these Terms creates any employment, agency, partnership, joint venture or franchise relationship between any Agent Participant and Treat Accessibly.

  1. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties attorn to the exclusive jurisdiction of the courts of the Province of Ontario.

  1. Electronic Acceptance

Acceptance of these Terms by checkbox, electronic signature or electronic communication is valid and binding to the same extent as a written signature.

  1. No Professional Advice

Program guidance, playbooks and templates are provided for general information only and do not constitute legal, insurance, safety, tax or other professional advice. Agent Participants should obtain their own professional advice.

  1. Amendment

Treat Accessibly may amend these Terms at any time by posting an updated version or notifying participants. Continued participation constitutes acceptance of amended Terms.
